On February 6, over 30 leaders from BUILD and Turn Around Tuesday joined with leaders from Public Justice, the Vera Institute of Public Justice, the NAACP Legal Defense Fund, and more to press for Maryland to pass Senator Shaneka Hensen's Fair Chance Housing Bill.
Maryland's Fair Chance Housing Bill is a legislative effort aimed at preventing housing discrimination against individuals with criminal records. The bill seeks to ensure that people with past convictions have a fair opportunity to secure housing without being automatically denied based on their criminal history.
Key Provisions of the Bill:
- Restricts Criminal Background Checks: Landlords would be limited in using criminal records in the tenant screening process. They might only be allowed to consider certain serious offenses or offenses within a specific timeframe.
- Prohibits Blanket Bans: The bill would prevent landlords from implementing blanket policies that automatically reject applicants with criminal histories.
- Encourages Individualized Assessments: Landlords would be encouraged to evaluate applicants on a case-by-case basis, considering factors such as rehabilitation, time since the offense, and other circumstances.
- Aims to Reduce Recidivism & Homelessness: By providing stable housing opportunities, the bill seeks to help formerly incarcerated individuals reintegrate into society, reducing homelessness and the likelihood of reoffending.
- Protects Public Safety & Fair Housing Rights: The bill aligns with fair housing principles and aims to ensure that people are not unjustly denied housing opportunities.
As of February 20, 2025, the Maryland Fair Chance Housing Act (House Bill 1077) is progressing through the legislative process in the Maryland General Assembly. The bill has been referred to the House Environment and Transportation Committee, and a hearing is set for February 25, 2025, at 1:00 p.m. During this hearing, stakeholders, including lawmakers, housing advocates, landlords, and members of the public, will have the opportunity to present their views and testimonies regarding the bill.
